Agenda

Whether you are a novice or an experienced litigator, plaintiff or defense counsel, this seminar is designed to teach by example and assist you in your next trial and trials thereafter..  Our experienced panel will demonstrate various aspects of a medical malpractice case.  These skills will be useful to you in essentially any trial.

TOPICS TO BE INCLUDED:

  • Opening and Closing Statements;
  • Use of Medical Literature;
  • Direct and Cross-Examination of Experts, Plaintiffs and Defendants.

THE CASE
The case you will consider involves a 27 year old male plaintiff who undergoes a routine outpatient biopsy of a vocal cord polyp.  He awakens from the surgery with a significantly different diagnosis, one that will require lifelong management. Here are just a few of the questions to be addressed:

  • Did the physician perform the procedure that he claimed to have performed?
  • Did the plaintiff consent to the procedure?
  • Was the procedure within the acceptable standard of care?
  • Did the plaintiff sustain damages?
