THE CASE
The case you will consider involves a 27 year old male plaintiff who undergoes a routine outpatient biopsy of a vocal cord polyp.  He awakens from the surgery with a significantly different diagnosis, one that will require lifelong management. Here are just a few of the questions to be addressed:

  • Did the physician perform the procedure that he claimed to have performed?
  • Did the plaintiff consent to the procedure?
  • Was the procedure within the acceptable standard of care? 
  • Did the plaintiff sustain damages?
