This seminar will cover the trial presentation of a trip and fall case. The case involves a fall suffered by an 84 year old woman who tripped on a wire while walking in a greenhouse at a nursery. The defense claimed that the plaintiff could not have physically entered the greenhouse and should have seen the wire.
Counsel will conduct direct and cross examination of the Plaintiff, Business Owner and Expert Engineer with a focus on proving liability. Participants will have the chance to review the complaint, mediation paper, photographs, medical records and deposition transcripts from the actual case.
TOPICS TO INCLUDE:
- How to prove liability in difficult trip and fall cases?
- How to deflect the defendant's claim of comparative negligence?
- How to effectively present testimony of an expert to best support your case?
- How to use the testimony of the defendant to help prove your case?
- How to deal with plaintiffs per-existing health conditions?
